Workseekers Agreement

We are required by law to have a workseeker’s agreement which you can see here. Please read this before sending us your CV.

This Agreement (“the Agreement”) sets out details which Searchlight is required to give a work-seeker under the Conduct of Employment Agencies and Employment Business Regulations 2003.

Searchlight will operate as an employment agency in relation to the Work-seeker.

1.1 In this Agreement the following definitions apply:

“Client” means the person; firm; company, together with a subsidiary or holding company of any such company (as defined by section 736 of The Companies Act 1985) to whom an Introduction is made;

“Employment” means the engagement, employment or use of the Work-seeker, directly by the Client or any third party or through any other agency on a permanent or temporary basis, whether under a contract of service or for services; an agency, licence, franchise or partnership arrangement; or any other engagement;

“Introduction” means (i) the interview of the Work-seeker, in person or by telephone, by a Client or (ii) the passing to a Client of information by Searchlight which identifies the Work-seeker whether directly or indirectly;

“Remuneration” means base salary or fees.

1.2 No variation or alteration to this Agreement shall be valid unless the details of such variation are agreed between Searchlight and the Work-seeker and set out in writing and a copy of the varied terms is given to the Work-seeker stating the date on or after which such varied terms shall apply.

2. DATA PROTECTION

2.1 In accordance with the Data Protection Act 1998, the Work-seeker agrees that personal data regarding the Work-seeker may be retained and processed by Searchlight for the purpose of considering the Work-seeker for suitable employment.

2.2 By entering into this Agreement, the Work-seeker consents to Searchlight disclosing information about the Work-seeker in order to provide work finding services to the Work-seeker.

3. AGENCY’S OBLIGATIONS

3.1 Searchlight agrees to contact the work seeker with regard to appropriate opportunities within the media industries.

3.2 At the same time as an opportunity for employment is offered to the Work-seeker, Searchlight shall inform the Work-seeker of the identity of the Client, and if applicable the nature of their business; the date the work is to commence and the duration or the likely duration of the work; the position which the Client seeks to fill, including the type of work the Work-seeker will be required to do; location and hours during which the Work-seeker would be required to work; the rate of remuneration that will be paid and any expenses payable; the minimum rate of remuneration and any other benefits which the Client would offer to a person in the position which it seeks to fill, and the intervals at which the person would be paid; where applicable, the length of notice which a Work-seeker in such a position would be required to give and entitled to receive, to terminate the employment with the Client; and any risks to health and safety known to the Client and the steps the Client has taken to prevent or control such risks. In addition Searchlight shall inform the Work-seeker what experience, training, qualifications and any authorisation required by law or a professional body the Client considers necessary or which are required by law to work in the employment..

4. RIGHTS AND OBLIGATIONS OF THE WORK-SEEKER

4.1 The Work-seeker confirms that when supplied by Searchlight to a Client he or she has the relevant experience and qualifications required by the Client.

4.2 The Work-seeker acknowledges that there may be periods when no suitable opportunities for employment are available and agrees: that suitability of the employment shall be determined solely by Searchlight; that Searchlight shall incur no liability to the Work-seeker should it fail to offer opportunities for employment; and that the terms of this Agreement are between the Work-seeker and Searchlight (for the avoidance of doubt, this Agreement and/or the relationship between the parties does not create an employer/employee relationship).

5. PAYMENT

5.1 The Work-seeker agrees:

a) To notify Searchlight immediately of any offer of employment from a Client:
b) To notify Searchlight immediately that it has accepted any offer of employment from a Client, and to provide details of the remuneration to Searchlight.

8. TERMINATION

8.1 Searchlight or the Work-seeker may terminate this Agreement at any time upon giving one week’s notice in writing to the other.

10. LIABILITY

10.1 Notwithstanding clause 5.5 of this Agreement the Work-seeker shall satisfy itself as to the suitability of any employment and of any Client to whom the Work-seeker is introduced. The Work-seeker is responsible for obtaining work permits and/or such other permission to work as may be required, and/or investigations into the Client and satisfying any medical and other requirements, qualifications, or permission required by law of the country in which the employment is offered.

11. LAW

11.1 These terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the courts of England & Wales. Both parties warrant that subject to communication of this Agreement, the Agreement is deemed to be accepted by the Work-seeker unless the Work-seeker notifies Searchlight otherwise in writing.
